1. Good day po! Dati po akong ofw sa dubai. Nawalan po ako ng work at nagkacase dahil sa loan and creditcard na di ko nabayaran. Imbes na tumakas, nagpakulong ko po ako ng 2 months sa dubai until makauwi po ako ng pinas. May dala po akong case closure from court at clearance from dubai police. That was december 2017. Today po may nareceive akong email from a law firm dito sa pinas as mentioned below:

   “We have been exhausting all available legal means to reach you and discuss a possible out-of-court settlement of your credit card obligation to our client – Emirates NBD. Unfortunately, it appears that you have been continuously ignoring our efforts and evading the payment of your obligations with ENBD.

   Kindly take note that we are willing to assist you in settling your obligations with Emirates NBD. However, in view of your failure to cooperate with us, you are leaving us with no choice but to formally recommend to ENBD the immediate filing of the appropriate civil and criminal case/s against you in the proper court of Dubai/UAE, or in any other jurisdiction where you are presently staying/working.

   Please be advised that, in the event a foreign court’s decision becomes final and executory, we may initiate the filing of a petition before the Regional Trial Court of the province where you and/or your properties may be found for the enforcement of the foreign judgment. Once granted, we will definitely implement the decision and proceed to levy your real and personal properties and garnish your bank accounts. In addition, subject to our law and the prevailing laws of the country you were staying/working, we may also seek the cancellation of your passport and/or other travel documents, as may be allowed under the circumstances, and commence deportation proceedings against you.

   This notwithstanding, we are still giving you a non-extendible period of THREE (3) days from receipt hereof to settle your above mentioned account. We hope you will to settle the said obligation amicably with our client to avoid further legal complications.”

   Legal po ba ito? Nakulong na po ako at closed na po yng case ko sa dubai. Bakit may ganito po ulit?

   Can we ask for a appeal with the building management?

Nabangga po ang aming sasakyan last week and made a deal sa nakabangga na ipapaayos nila, we haven’t heard from the owner of the other vehicle since the incident happened. May police report naman pong napagawa and both parties already claimed the said police report. Ano po ba ang next step na namin? Mahal po ba magsampa ng kaso?

       1. Yes it is allowed. Under CIRCULAR NO. 398
          Series of 2003, Subsecs. X320.12 and 4301N.12 Offsets. For purposes of transparency and adequate disclosure, the credit card issuer shall inform/notify the credit cardholder in the agreement, contract or any equivalent document governing the issuance or use of the credit card that, pursuant to the provisions of Articles 1278 to 1290 of the New Civil Code of the Philippines, as amended the use of his credit card will subject his deposit/s with the bank to offset against any amount/s due and payable on his credit card which have not been paid in accordance with the terms of the agreement/contract.

13. Good afternoon atty, nag rent po kmi ng store 4,500 per month. Nag start po kmi last May 14, 2019 but nag paalam na po kmi sa may ari na hindi na namin tatapusin ang rent namin. Sa part ko po, agrabyado po ako kse po hindi ko po kasalanan if wala agad magre rent sa store nila kapag umalis kmi bakit babawasan po yung deposit ko na hindi na ako nag ooperate at wala na mga gamit ko?

    Bf ko po, naturalized US-citizen, nagpakasal sya dito s pinas sa isang pinay then they lived sa US. After sometime nagfile ng divorce ang wife nya at nagrant naman po sa US. Questions po, paano at saan po namin ifa-file ang divorce ni bf para ma-recognize dito sa pinas? Anu-ano po mga kilangang documents to file for the said recognition? Kilangan din po ma-red ribbon lahat ng papers or documents? And saan po namin gagawin iyon? Thank you po.

    1. If your bf is a foreign citizen or not a Filipino citizen, there is no need to file a recognition of foreign divorce. Para siya nagpakasal kailangan lang niya mag present ng affidavit to legal capacity to marry

    Im a teacher po, nagpapabago po kasi ng grade ang student ko na running for cum laude. Hindi ko naman po babaguhin at wala po akong balak baguhin. Dumating sa punto na pinuntahan ng tatay ng student ko ang papa ko para makiusap baguhin ang grade. Dahil nalaman nilang kamag-anak po pala namin sila. Good morning po, itatanong ko lang po kung ano pong pwede kong gawin, nakapag loan po kasi ako sa isang online lending, nasettle ko siya pero di ko nakuha ung receipt sa counter dahil nagmamdali po ako, ngayon po pinagttext po ako na overdue ko na po kaya sinabi ko nasettle ko na hanggang sa hinack nila ung contact list ko at pinadalhan nila ng message na notice to the public,andun buong name at address ko at kakasuhan daw ako ng estafa, which is not true. kaya lang po kasi nabasa ng mga katrabaho ko at boss kaya po nagworried ako. tinawagan ko po ung nagsend which is his personal number and sabi nya kay lawyer velasco siya he didn’t give his complete address sabi lang taga mindanao daw siya. Nalaman ko rin po sa iba na with same case, na peke ung lawyer at nanakot lang daw po.
