Hi atty. Gusto ko lang po mag tanong nag seperate po kami ng partner ko meron kaming anak who is 5 years old. Hindi po kami kasal.. palagi po kami nag aaway kaya po kami nag hiwalay. Good morning! I am a former employee of one of the biggest call centers in Manila. My employment was recently terminated during the training period.
We have 3 stages of training, and each stage have a minimum score to meet in order to proceed to the next stage.
The minimum requirement for the first stage is 90%, second stage is 93%, and third stage is 95%.
Our training agreement states that out of the 5 assessments given on each stage of training, the lowest score may be removed upon the discretion of the training management. Which gives the trainee a chance to pass, in case he/she fails in one assessment.
I successfully reached the second stage of training. And I had an average score of 92.7% on 5 assessments. If my lowest score will be removed, it will give me an average score of 95% on four assessments.
During the one-on-one coaching session with our trainer regarding the final results of my assessments, she informed me that I had an overall good performance and my behavior in class was ideal. But to my surprise, my trainer informed me that the “training management” decided not to remove my lowest score. Thus, I failed in training, and my employment will be terminated immediately.
Then I later found out that two of my co-trainees who passed the second stage of training, actually had their lowest scores removed, which gave them the passing scores of 93% and 95% respectively.
I felt like I was unjustly terminated, since I was not informed why they did not consider removing my lowest score. And at the same time, the consideration to remove the lowest score was applied to my co-trainees.
Do I have sufficient grounds to challenge the management’s decision?
What would be my best course of action?

My mga lupa po ang papa ko na nakatitulo na sa pangalan niya pero ang mga tax declaration nakapangalan pa sa parents niya. Patay na rin po papa ko. Nag try po kami asikasuhin ilipat sa pangalan ni papa pero sabi kailngan pa daw pirma ng lahat ng mga kapatid. Ang problema po ay pinipilit po ng kapatid ng papa ko na binenta na daw sa kanila ang lupa at di sila pipirma pa matransfer yun. May iba pa po bang paraan kung pano siya malilipat sa pangalan ng papa or sa mama ko?

Ask ko lang po, valid po ba mag-request ng restraining order if ganito yung situation:
Bale yung “bilas” (husband ng sister ng partner) ko
doesn’t have a good history sa relatives ng asawa niya and/or in-laws namen.
They had their exchange of mostly bad verbal confrontations.
So initially po sila lang yun at wala ako sa eksena. Though my partner, now my fiancee had her fair share of bad verbal exchanges (mostly online and yrs ago).
So, I’ve been hearing from my “in-law” na ni-badmouth kami (mostly towards my partner) regarding our disposition in life, lifestyle and even major purchases.
I just ignored it kasi I don’t even see the person. Recently, they moved in sa same apartment building (different unit) na nirerent namen.
So again I heard these new badmouthing stories from my fiancee and her mother.
It was until I saw the actual words in my fiancee’s phone (screenshots sent by her mother) that made me both angry and worried about how this person thinks.
I don’t want to confront this kind of person and get the bad end of the stick.

Could a restraining order be filed in this scenario?

Goodevening Atty. My friend’s husband is having an affair for many years now with the same person. She didn’t pursue any legal action because she was afraid that by doing so may financially burden their children who are all studying, in case the husband stop giving financial support. Now, her husband and the mistress are becoming more daring in making their affair known even to their common friends which makes her angry because her children are getting hurt. BTW, all of their children are already aware of their father’s affair. The husband is an OFW who earn a very decent income and spend most of his vacation with his mistress travelling abroad and out of town at times with the mistress’ family (i.e. relatives, children). She also heard from their common friend that her husband is putting all his property under the name of his mistress so she worry about hers and her children’s legal rights to those properties. She is already planning to talk to the husband to lay down all her demands that includes fix financial support to their children so that they don’t have to feel as if their begging for it every month. But if this fails, what do you think are her legal options? Is there a way she can also pursue rights on the properties her husband put under the mistress name? Can she challenge her capacity to acquire those properties in court, in case she say that it came from her own money? Also, will her decision to not pursue legal option for a long while affect her case if she decides to bring this to court. Badly needed your advice. Thanks.
