Is 10 years of no communication whatsoever with his wife enough grounds to have his marriage null and void or is there a good chance that we can have his marriage annulled?

    Good day po,

    Yung (Person 1) kapatid ng partner ng ate ko po kasi ay gumawa ng posts sa facebook, at siniran po sila ng siniraan kasi ang ate ko po at ang partner nya yung nagbantay sa anak ni (Person 1) habang nasa abroad sya. Nag agree po sila na sasahod sya ng 4k kada buwan at libre na ang renta kasi nakikitira nadin samin ang bata pero wala naman po kaming problema don. Nagkautang po ang kapatid ni Person 1 sa kanya pero kahit po nagkautang sya ay ginagamit nya naman to para sa bahay na tinitirhan nya at ng anak ni Person 1. Bumalik ng pinas si Person 1 nung March 2019, pero simula po nung January ay hindi na sumasahod ang ate ni Person 1 pero okay lang sa kapatid nya at sa mga tao sa bahay.

    Recently po, nawalan napo ng pera si Person 1 kaya sinisingil nya yung utang na 10k sa kapatid nya, at napakataas pa ng tingin sa sarili kesyo nakatulong daw sya kaya may karapatan sya pati sa bahay na nakikita siya, anak nya at ang ate nya. Humingi ng konting pagitan ang ate nya sa pag bayad ng utang pero si Person 1 is napakatigas hangang sa nag away na at namisikal na si Person 1.

    Pinalayas po si Person 1 at ang anak nya dahil walang utang na loob na nakitira sa bahay, wala na ngang pinang sahod sa kapatid nya, dinamay pa lahat ng tao sa bahay.

    Yesterday po, nakareceive kami ng notification na nagposts po ang ex husband ni Person 1, na puro kasinungalingan kesyo binugbog daw anak niya at pinagtulungan ang mag ina nya.

    Tinatakot po ang kapatid nya at ang mga kasama sa bahay, na mag file daw sila ng child abuse pero wala naman sila proof na sinaktan anak nila. At ang bata ay masayang masaya sa puder namin at kahit akong hindi ko kaano ano yung bata ayy ginagastusan namin kasi ang ina mismo ay nagkukulang pati sa allowance.

    Isa pa pong issue. Ang kapatid ko po ay pinagkakalat nilang may HIV at ipinagsasabi sa ibat ibang tao

    Tanong ko po:

    1. Pwede po ba kasuhan ng Libel, kasi nakasulat po ang names ng ate ko at ang partner nya sa posts ni Person 1.
    2. Ano po ang process sa pag file ng case.
    3. Pwede po ba kasuhan dahil private po ang HIV at considered a disability.
    4. Child abuse po ba ang pag disciplina sa anak nya. Kasi mas worst pa po ang ginawa ni Person 1 kasi sa harap mismo ng anak nya ay nag scandalo sya.

  15. Hi attorney, I go by Goodluck, seeking legal advice is it okay to completely change the door keys of my rental unit by owner of the unit ? Couple of times I have returned to find the gate of my unit locked with a different key.
    Recently my unit owner refused me from getting into the house which I am renting because I’m delayed on unit rent.
    Secondly is it okay that the unit owner to speak about my delayed payment to neighbors or my male/Female friends who comes around to visit me.
    My property electric fan and dog cage that I kept outside my unit were discarded by the unit owner , All in an attempt to get ride of only the empty bottles outside, These items (The fan and dog cage)were neatly arranged outside because the motor of the fan needs to be change and my dog has been with a friend for a while now.
    Beyond 7pm the landlord knocked at my gate to demand his rent , On my way to school he stops me to demand payment for the rent.
    The unit owner goes in my unit without my consent, sometime I get to my apartment to find out my power supply has been interrupted by unit owner ,My food supplies in the ref went sour n bad.

    I’m working as an online tutor and at the same time a public servant in our barangay.
    I have made bad decisions last year, got myself into deep debt. With different lending companies and people, in total I have more or less 650k worth of debt. I don’t have any property or capacity to pay them for one time payment.
    I can work for it but I only earn 30k a month in tutoring, I can have extra jobs but they are all forcing me to pay. What must I do. Is it possible to set a meeting with them and tell them about my situation? Will I be imprisoned for this?

    Because of the process takes a long time, I am interested in the way of a court settlement.
    I am from Germany and would like to initiate a civil case against a Filipino.

    I’m interested in:
    Does the initiator always bear legal costs and attorny fees, or can they be shared by the court or imposed on the other party?
    Can be enforced the agreement by a court? e.g. the court makes a settlement proposal if one of the two parties does not agree.
    How long does such a procedure take?

  18. Just wanted to ask if it is allowed by law to not give the salary for the 10 days of service at the end of the month?

    For example:

    I work from June 3-15, but I won’t get my salary on the 20th. My first payroll would be on the next one but the scope of payment will just be from June 3-15. So, the service that I rendered from June 16-30 will not be paid yet.

    Therefore, I only receive half of my monthly salary for the month of June.

    And on the next month, The July 1-15 service, I will receive the June 16-30 pay.

    Is it allowed by law to withhold the 10 days of my salary and they would only give it upon resignation, to be included on my final pay?

    Because according to chapter IV article 116 regarding withholding of wages,“it shall be unlawful for any person, directly or indirectly, to withhold any amount from the wages of a worker or induce him to give up any part of his wages by force, stealth, intimidation, threat or by any other means whatsoever without the worker’s consent.”

    Is my understanding of this prohibition correct?

    I just want to clarify this because the value of money changes through time and the wages I can receive now could have a greater value if I tried to allocate it for investments.

    For me, it just feels like I the service I rendered for 10 days will be robbed from me.

Magandang araw po Atty..ngwork.po ako june 1995 up to feb 2008 ngresign po ako pero hindi ko po nakuha ang separatio pay ko..hindi na po kasi bumalik sa kumpanya wala po ako pinirmahan kahit ano docs maliban po wriiten resignation letter ko..sabi po ng HR sa akin tumawag po ako last week wala na daw po records ko tagal na daw po kasi..
